Trademark Registration in the UAE: Cost, Steps and Timeline

Trademarks in the UAE are registered nationally with the Ministry of Economy, and rights follow registration rather than use, so the first party to file for a mark in a class is normally the party who owns it. The process is: run a clearance search, choose the correct classes under the Nice Classification, file the application with the mark and the applicant's details, respond to any examination objection, publish, wait out the opposition period, and receive the certificate. Registration lasts ten years and is renewable. Official fees are set by the Ministry of Economy and are charged per class, so filing across several classes multiplies the cost.

Why registration matters more here

The UAE operates a first-to-file system. Trading under a name for years does not by itself give you a registered right, and a third party who registers the same mark in your class can create a serious problem for a business that is already operating under it.

A trade licence is not a trademark. A trade name approved by an economic department or free zone authority allows you to operate under that name; it does not give you exclusive rights to the brand across the UAE, and it does not stop someone registering a similar mark.

Before you file: search and classes

Clearance search

Search the register for identical and confusingly similar marks in your classes before you spend on branding. A search will not guarantee registration, but it identifies the obvious conflicts and the marks likely to generate an objection or an opposition.

Choosing classes

The UAE uses the Nice Classification, with goods and services split across 45 classes. You must file in every class you need; protection does not extend beyond them. A restaurant brand, for example, may need the food and beverage services class and separately the classes covering packaged goods it sells.

What can and cannot be registered

Distinctive words, logos, and combinations can be registered. Purely descriptive terms, generic names, marks contrary to public order or morals, marks resembling official emblems, and marks that conflict with earlier rights face refusal. A descriptive name is cheap to launch and expensive to defend.

The filing process, step by step

  1. Prepare the applicant details, the mark in the exact form to be used, the classes and the goods or services specification.
  2. File with the Ministry of Economy, paying the official fee per class.
  3. Examination. The examiner may raise objections on absolute grounds, such as descriptiveness, or on earlier conflicting marks. Objections can be responded to with argument or amendment.
  4. Publication. Accepted marks are published, which starts the period in which third parties can oppose.
  5. Opposition. If opposed, the matter is decided through the prescribed procedure; if not, the application proceeds.
  6. Registration and certificate issue.

Timelines depend on examination workload and whether an objection or opposition arises. A straightforward application is materially faster than one that draws an objection, and an opposed application can take considerably longer.

After registration: renewal, use and enforcement

  • Registration runs for ten years from the filing date and is renewable for further ten-year periods. Diarise the renewal; a lapsed mark is an avoidable loss.
  • Use the mark as registered. A registration can become vulnerable to cancellation where a mark is not used for an extended period.
  • Record assignments and licences, so the register reflects who actually owns and uses the mark — investors and acquirers check this.
  • Enforce through the available routes: administrative complaints to the economic department, customs recordal to intercept infringing imports, and civil or criminal proceedings depending on the conduct.
  • For regional coverage, consider the GCC and other markets separately. A UAE registration is national.
